【法規新訊】摩洛哥－新工業產權法（no. 23-13）

為了使摩洛哥工業產權提升至國際水平，摩洛哥新工業產權法(no. 23-13)主要目的係修正舊工業產權法(no.17/97)，該法案已於2014年12月18號生效，

新法並於2015年1月15號公告於官方公報。

新法摘要如下：

1. 無論是商標、專利、或者設計，現在皆需要先進行實質審查
2. 新的異議程序
3. 海關現在可以針對涉嫌仿冒的商品，不單禁止其進口，亦可禁止其出口及運輸
4. 現在無論是針對專利、商標或者設計，皆可提出分割案，但可能會延遲設計的揭露。
5. 申請中的案件亦可進行授權及移轉。
6. 接受與微生物(Micro-organisms)相關的專利申請
7. 設計專利有了新的保護期限。設計專利的保護期限為五年，可延展兩次，保護期限最高長達15年。[1]
8. 任何利害關係之第三人可對商標的絕對異議事由提起異議。

最主要的變化在於發明專利系統的改良、合併國家商標系統、改良國家工業設計系統、及落實智慧財產權。

New Law on Industrial Property in Morocco

A new industrial property law (no. 23-13) has been issued in Morocco to amend the law (no.17/97) related to Industrial Property. The said Law entered in force on December 18, 2014 and provides for the protection of industrial property rights in accordance with international standards in the field of industrial property. 

The new law entered into force on the date of publication in the official gazette on 15 January 2015.

Main features of the new law are summerized as follows:

1.        Prior substantive examination for trademarks, designs and patents applications is now required.

2.        A new opposition procedure entered into effect.

3.        The Customs administration is now entitled to block suspected counterfeited goods not only for importation but also for exportation and in transit.

4.        It will be now be possible to file divisional applications either for patents, trademarks and designs and models, possibility to delay the disclosure of a design & model.

5.        licensing and assignments allowed for pending applications.

6.        Aceptance of patents related to Micro-organisms.

7.        New duration of design & model rights.

8.        It will be possible to any interested third parties to oppose a trademark on absolute grounds, calculation of deadlines before the PTO.

Moreover, major changes were made regarding the improvement of the invention patent system, the consolidation of the national trademark system, the reform of the national system of industrial designs and the enforcement of IP rights.
