美國USPTO發布與俄羅斯專利局關係的最新消息

美國專利商標局（下稱「USPTO」）於2022年5月5日宣布，在美國財政部外國資產控制辦公室（U.S. Department of Treasury’s Office of Foreign Assets Control，下稱「OFAC」）公佈第31號「一般授權」後，某些與智慧財產權相關的交易現已在俄羅斯獲得授權。授權交易包括提交和起訴任何獲得專利、商標或著作權的申請，以及續訂和維護費用。
過去，USPTO曾在3月宣布，其將終止與俄羅斯聯邦智慧財產權局 （下稱，「Rospatent」）、歐亞專利組織（Eurasian Patent Organization，下稱「EAPO」）以及一直與俄羅斯合作的白俄羅斯智慧財產權局的合作。該局還表示，自3月11日起，當這些請求基於Rospatent作為早期審查局所做的工作時，它將不再批准參與USPTO全球專利審查高速公路（Global Patent Prosecution Highway，下稱「GPPH」）的請求。而且，USPTO聲明稱根據GPPH授予基於Rospatent工作的申請的特殊地位的未決案件中，USPTO將取消該地位並將這些申請退回到常規處理和審查行列，這意味著它們將不再被處理作為USPTO的GPPH申請。
但是，根據第31號的「一般授權」，以下本應被《俄羅斯有害外國活動制裁條例》（Russian Harmful Foreign Activities Sanctions Regulation，下稱「RuHSR」)）（31 CFR第587部分）禁止的交易，現在已獲得授權：
1. 為獲得專利、商標、著作權或其他形式的智慧財產權保護的任何申請的提交和起訴；
2. 獲得專利、商標、著作權或其他形式的智慧財產權保護；
3. 專利、商標、著作權或其他形式的智慧財產權保護的更新或維持；和
4. 就專利、商標、著作權或其他形式的智慧財產權保護提出和起訴任何反對或侵權程序，或對任何此類程序進行抗辯。
不授權根據第14024號行政命令「針對俄羅斯聯邦政府的特定有害外國活動來封鎖財產」的規定，向任何俄羅斯金融機構開立、維持或借記，或將其進口到俄羅斯境內。美國 14066 或 14068 號行政命令禁止的產品。
根據第14024號行政命令的規定，「一般授權」不授權向任何俄羅斯金融機構開立、維持或借記，乃依據「針對俄羅斯聯邦政府的特定有害外國活動來封鎖財產」或將第14066或14068號行政命令禁止的產品進口到美國。
該公告應為智慧財產權所有者提供一些明確性，因為以前不清楚有哪些制裁的例外情況將會被允許。
